By registering for the Virtusan Beta Users Program, you agree to the following terms.

1. Program Overview

Virtusan AG ("Virtusan", "we", "us") is inviting a limited number of individuals to test its smart ring and mobile application ("the Products") as part of a structured feedback program. Participation is subject to eligibility screening and acceptance by Virtusan.

2. Eligibility

Participation is by invitation only. Virtusan selects participants based on user profiles submitted at registration. We reserve the right to accept or reject any application at our sole discretion, without obligation to provide reasons.

3. What You Receive

Accepted participants will receive 1 Virtusan smart ring at no cost or reduced cost, plus 12 months of Premium App access.

These benefits are provided solely in exchange for your participation and feedback. They are non-transferable and have no cash value.

4. Your Commitments

By accepting a place in the program, you agree to:

1. Wear the ring continuously for a minimum of 90 days from the date of receipt.
2. Complete online surveys when requested.
3. Report issues in detail using the method and template provided by Virtusan.
4. Attend video calls — up to 4 sessions of approximately 30 minutes each — scheduled at mutually convenient times.
5. Engage honestly, provide genuine, detailed feedback about your experience with the product.

Failure to meet these commitments may result in removal from the program. Virtusan reserves the right to request the return of the ring in such cases.

5. Communications

By participating, you consent to receiving program-related communications from Virtusan via email and other channels, including:

• Survey invitations
• Video call scheduling requests
• Product updates and feature previews
• Program-related announcements

You may opt out of marketing communications at any time, but doing so does not affect your program obligations.

6. Data & Privacy

Your health and biometric data collected via the ring and app will be processed in accordance with Virtusan's Privacy Policy. By participating, you consent to Virtusan using your anonymised and aggregated feedback and usage data for product development purposes. No personal data will be shared with third parties without your explicit consent.

7. Intellectual Property & Confidentiality

Features, content, or functionality shared with you during the program may be pre-release and confidential. You agree not to publicly disclose, reproduce, or share details of unreleased features without Virtusan's prior written consent.

8. No Warranty

The Products are provided in a beta state and may contain errors or unexpected behaviour. Virtusan makes no guarantees regarding performance, accuracy of health data, or fitness for any medical purpose. The Products are not medical devices and should not be used as a substitute for professional medical advice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Virtusan shall not be liable for any indirect, incidental, or consequential damages arising from your participation in the program or use of the Products.

10. Termination

Virtusan may terminate your participation at any time if you breach these Terms, provide fraudulent information, or if the program is discontinued. You may withdraw from the program at any time by notifying us in writing, though the ring benefit may not be retained if withdrawal occurs within the first 30 days.

11. Governing Law

These Terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
